(Studio) President Johnson withdraws Abe Fortas' name as Chief Justice nominee at Fortas' request. Calls Senator refusal to end filibuster historical and Const. tragedy. President appointed for Chief Justice hasn't been defeated since 1795.

(DC) In letter to President, Fortas calls Senator attacks on Supreme Court destructive and extreme and should be ended before court meets for new term. [Senator Robert GRIFFIN - says future President will take great care with nominations. Senator taking advise and consent role seriously will help court] Fortas observing religious holiday.
