(Studio) Senator Judiciary Committee approves Abe Fortas nomination.
REPORTER: Walter Cronkite
(DC) [Chairperson James EASTLAND - says committee voted 10-6. Doesn't think Senator will confirm him.] Committee permits absent Senator Russell Long to vote via phone, making vote 11-6. No votes: Eastland, Sam Ervin, John McClellan, Strom Thurmond, Howard Baker and Hiram Fong. Debate in Senate opens next week Doubtful filibuster can be broken. [Senator Philip HART - says miserable precedent that this legislature branch shall thwart, by filibuster, the judicial and executive branches.] [Senator BAKER - says not miserable precedent when Senator exercising Const. mandate to advise and consent with President on appointed Senator doing what Const. framers expected.] Senator Mike Mansfield to give Senator full week before he moves to close debate. Says he can't pull rabbit out of hat.
