(Studio) Judge Gerhard Gesell refuses to enforce Senate Watergate subpoena for 5 White House tape recordings.
REPORTER: Howard K. Smith

(DC) Judge John Sirica rejected committee 's 1st lawsuit, but Congress passed special law, ordering courts to take case, but Judge Gesell dismisses 2nd lawsuit. Judge Gesell's reasons outlined. Judge also rules President can't keep tapes confidential; House Judiciary Committee likely to get tapes if requested.
